Owner Contract

1. Governing Terms and Conditions

1.1. This Owner Contract (“Contract”) is a legally binding agreement between You (the “Owner”) and My Local Party Hire (ABN [Insert ABN]) and consists of:

  • These Terms and Conditions;
  • The MLPH Privacy Policy;
  • The MLPH Website Terms of Use.

1.2. By listing items for hire on the MLPH platform, you agree to be bound by this Contract in relation to each booking.

1.3. This Contract is governed by the laws of Queensland, Australia. You and any Renter agree to submit to the non-exclusive jurisdiction of the courts of Queensland.

1.4. These Terms are subject to protections under the Australian Consumer Law (ACL) and nothing in this agreement excludes, restricts, or modifies rights under the ACL.

1.5. MLPH may amend these Terms with 7 days' notice to you. Continued use of the platform constitutes acceptance of the updated Terms.

2. Appointment of MLPH as Limited Agent

2.1. You appoint MLPH as your limited agent solely for the purposes of:

  • Facilitating bookings;
  • Collecting and holding payments from Renters;
  • Processing refunds or bond claims;
  • Communicating on your behalf for support purposes.

2.2. MLPH does not act as your general agent and does not assume responsibility for your actions or omissions.

2.3. Nothing in this Contract creates a partnership, employment relationship, or joint venture between you and MLPH.

3. Owner Obligations

3.1. You must ensure each item listed is:

  • Accurately described with clear, recent photos;
  • In good working condition and safe to use;
  • Available during the listed availability dates;
  • Compliant with all relevant Australian safety laws.

3.2. You warrant that:

  • You have legal authority to list and hire out the item;
  • The item is not subject to undisclosed security interests;
  • The information you provide is truthful and complete.

3.3. You agree to:

  • Keep your availability calendar up to date;
  • Respond to booking requests or enquiries within 48 hours;
  • Notify MLPH of any changes in ownership or legal disputes involving the item.

3.4. You must maintain each item in safe, operable condition and comply with any scheduled servicing or inspections required for its safe use.

3.5. You may not sub-list or transfer bookings outside the MLPH platform.

4. Item Handover Responsibilities

4.1. Prior to handover, the item must be:

  • Clean and free from defects;
  • Fully functional and ready for use;
  • Accompanied by any relevant instructions or safety information.

4.2. At the time of handover, you should:

  • Verify the identity of the Renter (e.g., via photo ID);
  • Demonstrate how to set up or use the item safely;
  • Take photos of the item’s condition (recommended for bond disputes).

4.3. Any personal items or materials not part of the hire must be removed.

5. Payment and Fees

5.1. MLPH will process all payments from Renters and release the Owner’s portion (“Payout”) within 3 business days of the confirmed start of the hire, unless a dispute or delay is flagged.

5.2. You authorise MLPH to deduct:

  • Platform service fees;
  • Bond claims approved by MLPH;
  • Any other agreed deductions (e.g. refund adjustments).

5.3. MLPH is not liable for failed Renter payments unless already released to the Owner.

6. Owner Cancellations and Refund Policy

6.1. As an Owner, you may cancel a confirmed booking at any time via your MLPH dashboard or by contacting us in writing. However, frequent or last-minute cancellations may negatively affect your visibility and credibility on the platform.

6.2. In the event of a cancellation by you (the Owner), the Renter will receive a full refund, including any service fees. MLPH reserves the right to recover these amounts from your account balance or future payouts.

6.3. If you must cancel within 48 hours of the scheduled hire time, you must notify MLPH immediately at hello@mylocalpartyhire.com.au so we can assist the Renter in finding an alternative option.

6.4. Repeated cancellations without valid reason may result in account review, temporary suspension, or removal from the platform.

6.5. If your cancellation is due to exceptional circumstances (e.g. natural disaster, serious illness, or damage to hire items), you may submit supporting documentation. MLPH will consider these cases on a discretionary basis.

6.6. "Scheduled hire time" refers to the delivery or collection time confirmed at checkout. All times are based on AEST (Brisbane time).

7. Risk, Insurance and Liability

  • 7.1. You are responsible for insuring your item against:
    • Loss, theft, or damage;
    • Third-party liability (where applicable);
    • Business interruption (optional).
  • 7.2. MLPH does not provide insurance for Owners or Renters.
  • 7.3. You accept the risks associated with hiring out your items and indemnify MLPH for any legal claims arising from your item or your conduct.

8. Disputes, Damage & Bond Claims

  • 8.1. You may request MLPH to claim part or all of the bond if:
    • The item is returned damaged, incomplete, or late;
    • Cleaning or repair is reasonably required.
  • 8.2. MLPH will act as facilitator of disputes but is not an arbitrator or insurer.
  • 8.3. You agree to provide:
    • Evidence of the condition before and after hire;
    • Repair or cleaning quotes (if applicable);
    • Photos or documentation to support any claim.
  • 8.4. Bond claims must be submitted within 48 hours of the item’s return. Claims made after this timeframe may not be accepted unless exceptional circumstances are demonstrated.

9. Termination and Account Suspension

  • 9.1. MLPH may suspend or terminate your account without notice if:
    • You breach this Contract or any other platform terms;
    • You repeatedly cancel bookings or receive serious complaints;
    • Your items are deemed unsafe or misleadingly advertised.
  • 9.2. You may terminate this agreement by removing all listings and notifying MLPH in writing. Any pending bookings must still be honoured or cancelled with notice.

10. Intellectual Property

  • 10.1. All brand assets, content, logos and system materials created by or for MLPH remain the property of MLPH.
  • 10.2. You grant MLPH a limited licence to use your item images, business name, and descriptions for marketing and listing purposes.

11. Indemnity

You agree to indemnify and hold harmless MLPH against any loss, damage, claim, expense, or liability (including legal fees) arising from:

  • Your breach of this Contract;
  • Your item causing harm to any person or property;
  • Any false or misleading information in your listing.

12. Confidentiality

You agree not to disclose confidential information about MLPH’s business practices, pricing, or technology to third parties, except as required by law.

13. Dispute Resolution

  • 13.1. You agree to attempt resolution of disputes with Renters directly in good faith.
  • 13.2. If needed, you may escalate the issue to MLPH support.
  • 13.3. If a dispute is unresolved, either party may request formal mediation in Queensland, Australia.

14. Notices

All formal notices under this Contract must be in writing and sent via email to the addresses provided in your MLPH account. Notices are deemed received upon confirmation of delivery.

16. Definitions

MLPH: My Local Party Hire.
Owner (You): The individual or business listing an item for hire.
Renter: The person who books your item via the platform.
Hire Item: Any product or equipment made available for hire.
Payout: The amount paid to you after fees and deductions.
Bond: A refundable security deposit held for damage, loss, or breach of terms.
Platform: The MLPH website and associated services.
