Terms of Service

Please read these terms of service carefully before using Our Service.

1 - Interpretation and Definitions

1.1 - Interpretation

The words of which the initial letter is capitalised have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in the singular or in the plural.

1.2 - Definitions

For the purposes of these Terms of Service:

  • Account means a unique account created for You to access our Service or parts of our Service.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party...
  • Application means the software program provided by the Operator downloaded by You on any electronic device, named My Local Party Hire.
  • Renter refers to users of the Service who are placing bookings for party and event hire items.
  • Country refers to Australia.
  • Company refers to My Local Party Hire, registered in Queensland, Australia.
  • Content refers to content such as text, images, or other information that can be posted, uploaded, linked to, or otherwise made available by You.
  • Device means any device that can access the Service.
  • Feedback means feedback, innovations, or suggestions sent by You.
  • Good refers to party and event items made available for hire.
  • Operator refers to My Local Party Hire.
  • Order means a request by You to hire Goods on the platform.
  • Owner refers to users listing Goods for hire.
  • Service refers to the Application or the Website or both.
  • Terms of Service mean this agreement.
  • Third-party Social Media Service means external services made available via the platform.
  • Website refers to My Local Party Hire, accessible at https://www.mylocalpartyhire.com.au.
  • You means the user of the platform.

These are the Terms of Service governing your use of the My Local Party Hire platform...

Your access to and use of the Service is conditional on your acceptance of and compliance with these Terms.

You represent that You are over the age of legal majority in your jurisdiction or in Australia (whichever is higher).

Your use of the Service is also subject to our Privacy Policy.

4 - Governing Law

These Terms are governed by the laws of Australia. You agree to the jurisdiction of the courts in Queensland, Australia.

You are responsible for compliance with all relevant Australian laws.

4.3 – Severability

If any provision of these Terms is found to be invalid or unenforceable under applicable law, that provision will be interpreted and adjusted to best reflect the original intent and purpose, to the maximum extent allowed. All other provisions will remain valid and enforceable in full.

4.4 – Waiver

Unless otherwise stated, the failure by My Local Party Hire to enforce any part of these Terms or to exercise a right does not waive our ability to do so in the future. Any waiver of a breach does not imply a waiver of any other or future breach.

5 – User Accounts

5.1 – Account Creation

When you create an account with My Local Party Hire, you must provide accurate, complete, and up-to-date information. Failure to do so may result in suspension or termination of your account.

You may not use a username that impersonates another person or business, infringes on a trademark, or contains offensive, vulgar, or inappropriate language.

5.2 – Account Information

You may be asked to provide information including your full name, email address, phone number, residential address, and payment details.

For identity verification or security purposes, we may request documents such as photo ID, proof of address, or business details if applicable. Owners may also be required to provide bank account details for payouts.

5.3 – Account Review

We do not routinely conduct background checks on users. My Local Party Hire makes no guarantees as to the accuracy, reliability, or completeness of user-submitted information. You should always take reasonable precautions when interacting with others on the platform.

5.4 – Account Password

You are responsible for keeping your password secure and for all activity associated with your account. Do not share your password with others.

Please notify us immediately at hello@mylocalpartyhire.com.au if you suspect unauthorised use of your account or a breach of security.

5.5 – Account Termination

We reserve the right to suspend or terminate your account at any time without prior notice if you breach these Terms or misuse the platform.

You may close your account at any time by deleting it from your profile settings or contacting us for assistance.

6 - Content

6.1 - Your Right to Post Content

Our platform allows You, as a Renter or Owner, to post Content, including listings, descriptions, photos, reviews, and other materials. You are solely responsible for the Content You publish on the Service, including its legality, reliability, and appropriateness.

By posting Content to My Local Party Hire, You grant Us a worldwide, non-exclusive, royalty-free license to use, copy, reproduce, modify, adapt, publish, display, and distribute such Content as needed to operate and promote the platform. You retain ownership of your Content, and it is your responsibility to ensure that You have the rights to use and share it.

You agree that this license also permits us to make Your Content visible to other users of the Service, including for browsing, booking, or communication purposes.

By submitting Content, You represent and warrant that:

  • The Content is owned by You, or You have full permission and rights to use it and grant us the license to display it.
  • The Content does not violate any rights of any third party, including but not limited to privacy rights, intellectual property rights, or contractual obligations.
  • The Content is not misleading, defamatory, offensive, obscene, or otherwise unlawful.

6.2 - Content Restrictions

My Local Party Hire is not responsible for the content posted by users of the platform. You expressly acknowledge and agree that You are solely responsible for any Content You upload, list, or share, and for all activity conducted through Your account—whether by You or by someone else using Your credentials.

You must not post, upload, transmit, or share any Content that is unlawful, offensive, upsetting, misleading, threatening, defamatory, obscene, or otherwise inappropriate. Examples of prohibited Content include, but are not limited to:

  • Content that is illegal or promotes illegal activity.
  • Discriminatory or hateful content, including remarks based on race, gender, religion, sexual orientation, ethnicity, or disability.
  • Spam, machine-generated or automatically posted content, chain letters, or any unauthorised marketing or solicitation.
  • Content that contains malware, viruses, or malicious code designed to disrupt systems or compromise data security.
  • Infringement of intellectual property rights, including copyrights, trademarks, patents, or trade secrets.
  • Impersonation of other individuals or businesses, including My Local Party Hire staff or representatives.
  • Content that violates the privacy of any individual, including personal data shared without consent.
  • False, misleading, or deceptive information, including fake reviews or fraudulent listings.

My Local Party Hire reserves the right—but not the obligation—to moderate, edit, or remove Content at its sole discretion if it is deemed to breach these Terms. We may also restrict or revoke access to the Service for users who violate these policies.

As we do not pre-screen all Content, You acknowledge that You may encounter material on the platform that You find offensive or objectionable. You agree that My Local Party Hire is not liable for any such Content, including any errors, omissions, or damages arising from its use.

6.3 - Content Backups

Although regular backups of Content may be performed, My Local Party Hire does not guarantee that there will be no loss or corruption of data.

Corrupt or invalid backup points may occur due to Content that is already corrupted before backup, or changes made to Content while a backup is in progress.

We will provide support and make reasonable efforts to identify and resolve any known issues that could affect the reliability of Content backups. However, You acknowledge that My Local Party Hire bears no liability for any failure to preserve or restore Content to a usable or original state.

It is Your responsibility to maintain an up-to-date, accurate copy of any important Content in a secure location separate from the Service.

6.4 - Intellectual Property of Others and Copyright Infringement

We respect the intellectual property and copyright rights of others. You may be held liable for damages (including legal costs) if You knowingly misrepresent that any Content on our Service infringes Your copyright. It is Our policy to respond to any valid claim that Content made available through the Service infringes the copyright or other intellectual property rights of another party, in accordance with Australian law.

If You are a copyright owner or an authorised representative and believe that material available on My Local Party Hire infringes Your rights under the Copyright Act 1968 (Cth), You may submit a takedown request to our designated contact (see Section 3 - Contact Us).

Please ensure Your written notice includes:

  • ✔️ A physical or electronic signature of the person authorised to act on behalf of the copyright owner.
  • ✔️ A description of the copyrighted work that You claim has been infringed, including a copy or URL to the original work.
  • ✔️ Identification of the URL or specific location on our Service where the infringing material is located.
  • ✔️ Your name, mailing address, telephone number, and email address.
  • ✔️ A statement that You believe, in good faith, that the disputed use is not authorised by the copyright owner, their agent, or the law.
  • ✔️ A statement, under penalty of perjury, that the information in Your notice is accurate and that You are the copyright owner or are authorised to act on their behalf.

Upon receiving a valid infringement notice, My Local Party Hire may, at its sole discretion, remove or disable access to the allegedly infringing content and take any further action it deems appropriate under Australian law.

7 - Orders Of Goods

By placing an Order for Goods through the My Local Party Hire platform, you confirm that you are over 18 years of age and legally capable of entering into binding agreements under Australian law.

7.1 - Role of the Service in Orders

My Local Party Hire acts solely as an introductory platform that connects Renters with Owners listing Goods for hire. We do not own or take possession of any Goods listed on the platform and are not a party to the contract formed between the Renter and the Owner.

As such, My Local Party Hire is not a party to any hire agreement you make with an Owner. Any contractual arrangement you enter into is strictly between you (the Renter) and the Owner and does not form part of any agreement with us. We do not accept any liability in relation to those agreements or any disputes that may arise from them.

7.2 - Your Information as Renter

When placing a booking through My Local Party Hire, you may be required to provide certain personal and payment details, including (but not limited to):

• Full name
• Email address
• Phone number
• Residential or event address
• Payment information (e.g. credit/debit card details)

You represent and warrant that:

• You are legally authorised to use the payment method provided
• All information you provide is accurate, current, and complete

By submitting your details, you consent to us sharing relevant information with third-party service providers (such as payment processors) solely for the purpose of processing your booking and delivering the service.

7.3 - Availability, Errors, and Inaccuracies

Listings and availability on My Local Party Hire are maintained by Owners. While we and our users strive to provide up-to-date and accurate listings, there may occasionally be errors relating to item availability, descriptions, pricing, or other details.

My Local Party Hire does not guarantee the accuracy or completeness of listings and reserves the right to correct any errors, omissions, or inaccuracies — including updating or removing listings — at any time without notice.

7.4 - Pricing Policy

Owners and My Local Party Hire reserve the right to adjust hire prices at any time prior to a booking being accepted.

After a booking has been accepted, prices may still be subject to change if affected by factors beyond the control of My Local Party Hire or the Owner, including:

• Changes in government regulation or charges
• Variations in GST or local taxes
• Increases in third-party service fees
• Currency conversion impacts (if applicable)

In such cases, you will be notified and given the option to cancel your booking without penalty.

7.5 - Payments

Payments can be made using the approved payment methods offered through My Local Party Hire. We use third-party payment providers who may have their own terms and limitations.

Payment cards (credit or debit) are subject to verification and authorisation by your bank or card issuer. If your payment is declined or not authorised, your booking may not be confirmed, and we will not be held responsible for any resulting delays or inability to secure the hire item.

7.6 - Service Fees

My Local Party Hire may charge service fees (inclusive of any applicable GST) for your use of the platform. Details of applicable fees and how they are calculated will be shown clearly at checkout when placing your Order.

For transparency, a 10% service fee is deducted from the vendor’s payout, and a 5% service fee is added to the customer’s total at checkout. These fees help cover platform maintenance, secure payments, and ongoing support.

We reserve the right to update or revise our service fees at any time. Changes will not apply to Orders already accepted prior to the change.

7.7 - Order Modifications

Renters and Owners are responsible for any changes to an Order agreed upon through the platform. You agree to pay any additional amounts, fees, or taxes associated with modifications to your booking.

7.8 - Order Cancellations

7.8.1 - Our Right to Cancel Orders

We reserve the right to cancel or refuse any Order at our sole discretion. This may occur for reasons including, but not limited to:

• Unavailability of Goods
• Errors in listing details or pricing
• Mistakes or inconsistencies in your Order
• Cancellation or error reported by the Owner
• Suspected fraud, unauthorised use, or illegal activity

If we cancel an Order, you will be notified and refunded in accordance with our refund policy.

7.8.2 - Cancellation by Renters

If you, as a Renter, cancel an Order more than 48 hours before the scheduled hire start time, you may be eligible for a full refund (excluding any non-refundable service fees.)

Cancellations made within 48 hours of the scheduled hire may not be refunded unless agreed upon by the Owner or required under Australian Consumer Law.

If circumstances outside your control require cancellation, or you believe you're entitled to a refund, please contact us to discuss your situation.

7.8.3 - Cancellation by Owners

If you, as an Owner, cancel an Order, the full amount paid by the Renter (including any service fees) will be refunded to the Renter and will not be transferred to you.

Owners should provide at least 48 hours’ notice when cancelling, where possible. If cancellation is required due to unforeseen circumstances, or you believe a refund should be disputed, please contact us as soon as possible.

8 - Disclaimer of Warranties and Limitation of Liability

8.1 - Limitation of Liability

My Local Party Hire’s total liability arising out of or in connection with the platform, the Services, or these Terms — whether in contract, tort (including negligence), equity, under statute, or otherwise — will be limited to the total service fees paid by you to My Local Party Hire in the twelve (12) months prior to the event giving rise to the liability, or one hundred dollars (AUD $100) if no such payments have been made.

This limitation of liability represents a fundamental element of the basis of the agreement between you and My Local Party Hire. It reflects the allocation of risk between the parties and will survive even if any limited remedy provided in these Terms is found to have failed in its essential purpose.

The limitations of liability in this clause are provided for the benefit of My Local Party Hire and will apply to the fullest extent permitted by Australian law.

8.2 - "AS IS" and "AS AVAILABLE" Disclaimer

The Service is provided to you on an “as is” and “as available” basis, with all faults, defects, and without warranty of any kind. To the fullest extent permitted under Australian law, My Local Party Hire, its affiliates, service providers, and licensors disclaim all warranties, express or implied, including but not limited to:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Title and non-infringement
• Warranties arising from course of dealing or trade usage

We do not warrant that the Service will meet your needs, function without errors, or be uninterrupted. No guarantee is made that the platform will operate reliably, integrate with other systems, or that any issues will be corrected.

Without limiting the above, My Local Party Hire makes no representations or warranties that:

• The Service will be available or operate without disruption
• Content, information, or listings will be accurate, reliable, or current
• Emails, content, or the platform will be free of malware, viruses, or other harmful components

Some Australian consumer laws may imply certain guarantees or warranties that cannot be excluded, restricted, or modified. In such cases, those statutory rights remain unaffected, and this clause applies only to the extent permitted by law.

8.3 - Links to Other Websites

Our platform may contain links to third-party websites or services that are not owned or operated by My Local Party Hire.

We have no control over and accept no responsibility for the content, privacy policies, or practices of any third-party sites or services. You acknowledge and agree that My Local Party Hire is not liable, directly or indirectly, for any loss or damage caused by the use of or reliance on any content, goods, or services available through those external sites or services.

We strongly recommend that you review the terms and privacy policies of any third-party websites or services you choose to visit.

8.4 - Translation Interpretation

These Terms of Service may have been made available in other languages for convenience. In the event of any inconsistency or dispute, the English version shall take precedence and apply.

9 - Dispute Resolution About the Service

If you have any concerns or disputes related to the My Local Party Hire platform or services, you agree to first attempt to resolve the matter informally by contacting us at hello@mylocalpartyhire.com.au.

10 - Intellectual Property of the Service

The My Local Party Hire platform and its original content (excluding content submitted by users), features, and functionality are and will remain the exclusive property of My Local Party Hire and its licensors.

The Service is protected under Australian copyright, trademark, and intellectual property laws, as well as international treaties.

Our trademarks, branding, and trade dress must not be used in connection with any product or service without prior written consent from My Local Party Hire.

11 - Your Feedback to Us

By submitting any feedback, suggestions, ideas, or improvements to My Local Party Hire, you assign all rights, title, and interest in that feedback to us.

If for any reason the above assignment is not valid, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide licence to use, reproduce, distribute, modify, sub-license, and otherwise exploit such feedback without restriction or compensation.

12 - Changes to These Terms of Service

My Local Party Hire reserves the right, at our sole discretion, to modify or replace these Terms of Service at any time. If changes are deemed material, we will make reasonable efforts to provide at least 30 days’ notice before the new terms take effect. What constitutes a material change will be determined by us.

By continuing to access or use the My Local Party Hire platform after the changes become effective, you agree to be bound by the updated Terms. If you do not agree with the revised terms, in whole or in part, you must stop using the website and services.
